DOJ Takes Legal Action Against Kansas School District Over Transgender Policies

The U.S. Department of Justice has initiated a federal lawsuit against the Kansas City, Kansas school district regarding its policies on transgender students. This action follows a year-long investigation prompted by a complaint from the conservative Defense of Freedom Institute.

The complaint alleged that the district's policies, which allow students to use preferred names and pronouns while evaluating parental involvement requests case-by-case, infringe on parental rights by not disclosing a student's transgender status without consent. In April, the Education Department determined that four Kansas districts were in violation of the Family Education Rights and Privacy Act (FERPA) due to these policies.

Despite the Department's findings, the Kansas City school district, which serves over 20,000 students, maintains its compliance with federal regulations and expressed disappointment over the lawsuit. Meanwhile, the Education Department is collaborating with the DOJ to enforce compliance among the districts.

In contrast, states like Idaho and Iowa have enacted laws mandating parental notification when students wish to change their name or pronoun as part of their gender transition. Kansas, however, lacks such legislation. The DOJ lawsuit marks the first instance where the current administration has utilized FERPA to assert parental rights regarding children's gender transitions.

Assistant Attorney General Harmeet K. Dhillon emphasized the importance of parental rights in public school operations, stating that the district should not prioritize its policies over parents' knowledge of their children. Kansas Attorney General Kris Kobach has also been vocal about school policies regarding transgender students, arguing that parents must be informed about significant aspects of their children's lives.

As investigations continue, the Department of Education recently announced that Topeka schools agreed to rescind their restrictive policies, while other districts like Olathe and Shawnee Mission have resisted compliance, potentially risking federal funding.
