Emmitt Smith Faces Lawsuit Over Alleged Misuse of Wind Farm Investment Funds

Emmitt Smith, the legendary running back for the Dallas Cowboys and NFL's all-time rushing leader, is embroiled in a legal battle with a Native American investment firm. Kituwah LLC has accused Smith and his business associates of misappropriating a $2.5 million loan intended for a wind farm project in Texas.

The lawsuit, filed this week in Delaware, alleges that 4 13 Solutions, the company associated with Smith, diverted the funds to repay a previous investor instead of using them for the wind farm venture, known as Project Exodus. Kituwah, which aims to invest in opportunities benefiting the Eastern Band of Cherokee Indians, is seeking damages and claims that the loan has accumulated an additional $600,000 in interest.

According to the suit, Smith and his longtime business partner, David Mosley, misled Kituwah regarding their efforts to secure a loan from the U.S. Department of Energy that would facilitate repayment. The complaint describes the situation as resembling a “ponzi scheme” and asserts that the defendants failed to meet necessary criteria for government funding, continually providing excuses for the project's delays. Kituwah states they provided the loan on September 1, 2023, with the expectation of a swift return, yet a month prior to the promised operational date of December 2024, they have seen no evidence of the project’s existence.
