Federal Judges Block Trump's Postal Voting Restrictions Amid Midterm Elections

In a significant judicial setback for the Trump administration, a second federal judge has issued an injunction preventing the implementation of new mail-in voting regulations by the U.S. Postal Service. This ruling arrives just weeks before the crucial November 3 midterm elections, where Republicans are keen to retain their hold on Congress.

Judge Nichols' Ruling

U.S. District Judge Carl Nichols, appointed by Trump himself, granted the Democratic Party's request for a preliminary injunction, citing concerns that the proposed rule would hinder mail-in voting access. Nichols emphasized that the Postal Service lacked the statutory authority to enforce key aspects of the new regulation, stating, "No statute grants the Postal Service the power to issue key parts of the rule." This ruling follows an earlier decision by U.S. District Judge Indira Talwani in Boston, who blocked similar measures on September 4.

Concerns Over Voter Access

The Democratic Party argued that the proposed regulation was an unlawful intrusion into state-administered elections, which the U.S. Constitution reserves for states with congressional oversight. The Democrats contended that the rule could disenfranchise eligible voters by imposing unnecessary barriers, such as requiring states to compile lists of eligible voters for mail ballots and using unique barcodes on ballot envelopes. They stated, "Congress has enacted nothing to empower USPS or the President to interfere with States' decisions about who should receive a mail ballot or how mail-ballot envelopes should be designed."

Administration's Defense

In response, Justice Department attorneys contended that the USPS was not seeking to take over federal election administration, asserting that states would maintain control over voter eligibility. They argued that the rule would not displace any state election laws or prevent voters from casting their ballots by mail. As the case now heads to the Supreme Court, the final determination on whether these restrictions can be enforced remains pending.
