Burke's company is currently embroiled in allegations of possible forex infringements involving billions of rand, prompting a fierce legal battle with SARB. The situation has left the DA grappling with whether Burke should temporarily withdraw from his influential roles in Parliament. Initially, a statement from the party emphasized non-interference in the investigation. However, shortly after, Hill-Lewis insisted Burke step aside, a move that suggests a significant shift in the party's stance.

Adding to the complexity, sources within the DA have pointed out a possible linkage between Burke’s situation and the party's ongoing scrutiny of the Public Investment Corporation (PIC), which has recently faced its own governance challenges. The DA is currently advocating for accountability regarding substantial losses within the PIC's Isibaya Fund, further complicating the party's dynamics as it strives to maintain its reputation.

In light of these developments, Burke has publicly distanced himself from Kastelo, indicating that he is no longer a director, although his interests in various financial ventures remain a point of contention. Best practices suggest that individuals in his position should manage such interests through a blind trust, a standard that has not yet been clarified in his case.
