In a contentious legal atmosphere, U.S. Attorney Jeanine Pirro is not ready to completely close the book on the case against David Hearn, a former Olympian accused of vandalism at the Lincoln Memorial Reflecting Pool. Despite the recent dismissal of felony charges against Hearn, Pirro's office is seeking to keep the option for re-prosecution alive.
Pirro's team filed a motion on Tuesday, arguing that while they agree to dismiss the current charges, the possibility of new evidence could warrant a grand jury's reconsideration of the case. "The mere potential that charges may be re-brought does not constitute the type of harassment for which dismissal with prejudice is appropriate," the filing stated.
Hearn's legal representatives have labeled the situation as "prosecutorial harassment," expressing concerns that the administration's political motivations could lead to renewed charges, even after the Department of Justice's own admissions pointed toward contractor errors rather than vandalism as the cause of damage. The Reflecting Pool’s damage, they argue, resulted from a poorly executed installation of a blue liner requested by former President Trump.
Trump himself has publicly criticized Pirro's decision, stating, "She folded like an umbrella," and indicating that he would prefer to see the case pursued vigorously. His administration, however, has acknowledged that the damage was likely due to contractor negligence, complicating the narrative of vandalism.
As the judge overseeing the case prepares to hold a hearing next month, the situation remains fraught with political tension. Hearn, who represented the U.S. in three Olympic Games, continues to assert that the charges against him were unfounded and driven by political pressure rather than substantial evidence.
