Federal Judge Blocks Trump's Birthright Citizenship Order Amid Legal Controversies

A federal judge has put a stop to Donald Trump’s latest efforts to alter birthright citizenship, following a Supreme Court ruling that reaffirmed the citizenship of children born in the U.S. to parents who are unlawfully present or temporarily residing.

Judge Deborah Boardman of the Maryland District Court ruled against the Trump administration’s executive orders, which sought to redefine citizenship criteria for children born to foreign government employees and those whose parents might be labeled as ‘alien enemies’ or involved in terrorism. This ruling comes after a series of legal challenges, including a class-action lawsuit aimed at protecting the citizenship rights of newborns affected by these orders.

In her decision, Judge Boardman emphasized that the core issue was whether the plaintiffs deserved legal protections against the new executive orders. She concluded affirmatively, stating that Trump’s measures are “almost certainly unconstitutional.” The judge pointed out that the Supreme Court had already established that the children in question are considered “citizens at birth,” thus requiring the enforcement of these orders to be halted.

Furthermore, Boardman highlighted ambiguity in the latest executive order, indicating that it does not explicitly state whether the new rules would apply retroactively. The original order suggested that it would affect only those born 30 days after its implementation on February 19, 2025, but the language of the newest order could place many more newborns in legal uncertainty.

The 14th Amendment clearly states that all individuals born in the U.S. are citizens, a principle upheld by a landmark 1898 decision in Wong Kim Ark. The Supreme Court's recent ruling reinforced this constitutional guarantee, directly conflicting with Trump’s attempts to limit citizenship based on parental status.

As Trump's administration continues to navigate legal challenges, Judge Boardman’s ruling serves as a reminder of the judiciary's role in upholding constitutional rights against unilateral executive actions.
