Court Ruling Upholds Free Speech in Face of Trump Administration's Deportation Efforts

A federal judge has delivered a significant blow to the Trump administration's efforts to deport noncitizen college students involved in pro-Palestinian advocacy. On August 28, 2026, U.S. District Judge Noel Wise, in San Jose, California, ruled that the legal framework used to revoke visas and initiate deportation proceedings against these activists is unconstitutional.

Judge Wise criticized the U.S. State Department and the Department of Homeland Security (DHS) for misusing federal immigration laws to silence dissenting views. She emphasized that free speech is a hallmark of democracy, stating, "That strength is diminished when members of our society – citizens and noncitizens alike – must self-censor and ‘behave’ or suffer the government’s retaliation."

The ruling stemmed from actions taken by the Trump administration in March 2025, which began with the detention of students like Mahmoud Khalil from Columbia University. Khalil is currently fighting his deportation. The Stanford Daily filed a lawsuit in August 2025, asserting that its writers felt compelled to avoid covering pro-Palestinian protests due to fears of government repercussions.

Judge Wise agreed with the newspaper’s lawyers, who argued that the provisions of the Immigration and Nationality Act, used to justify these deportations, violated the First and Fifth Amendments. She noted that when speech is targeted for deportation, it signifies unfavorable treatment based on viewpoint.

Conor Fitzpatrick, representing the Stanford Daily, hailed the ruling as a validation of the fundamental right to free speech. Wise’s decision resonates with a previous ruling by U.S. District Judge William Young, who also found the administration’s actions unconstitutional. Wise warned that such government overreach could extend to anyone expressing unpopular opinions, posing a threat to constitutional freedoms.
