Federal Judge Overturns Trump's Visa Ban for 75 Countries

A federal judge has ruled against a controversial visa ban affecting nationals from 75 countries, a significant setback for President Donald Trump's immigration agenda. The decision, handed down on August 21, 2026, by Judge Jeannette Vargas in New York, deemed the policy "contrary to law" and asserted that Secretary of State Marco Rubio overstepped his authority.
Implemented in January, the ban halted immigrant visa processing for individuals from countries such as Afghanistan, Brazil, Egypt, Iran, Iraq, Nigeria, Somalia, Thailand, and Yemen. The State Department justified the ban as a measure to prevent immigrants from high-risk nations from utilizing welfare or becoming public charges.
However, Judge Vargas found that consular officers were directed to deny visas solely based on applicants' countries of origin, despite their qualifications. Her ruling vacates these denials, and the government retains the option to appeal.
