Trump Administration Proposes Over $100,000 Fee for H-1B Visas

The Trump administration has unveiled a controversial plan to impose a staggering fee exceeding $100,000 on new H-1B visas, which are essential for hiring highly skilled foreign workers. This proposal, released on August 24, 2026, aims to solidify a temporary measure that faced legal challenges last year.

Initially instituted by President Trump in 2025, the hefty fee faced a legal setback when a federal judge ruled it illegal in June. The decision is currently under review by an appeals court in Boston, while another court evaluates a challenge from a major business group regarding the fee's legality. The administration's efforts to cement the fee into regulation could soon take shape, with a 30-day public comment period now open following the rule's posting in the Federal Register.

The proposed fee of $103,265 for H-1B applications starkly contrasts with the previous costs, which typically ranged from $2,000 to $5,000. This significant increase has raised concerns among various stakeholders, including business groups and employers who argue that the H-1B program addresses a critical shortage of qualified American workers in specialized fields.

Despite Trump and his supporters claiming that many companies exploit the H-1B program to undercut American labor, a substantial number of employers argue that these visas are vital for attracting top talent. As of late February, around 70 employers had already paid the new fee for a total of 85 applications.

Legal challenges are mounting against the proposed fee, with the U.S. Chamber of Commerce and several Democratic-led states seeking to block it. They argue that the president's authority does not extend to overriding the laws governing the H-1B visa program. Moreover, critics contend that the Department of Homeland Security lacks the authority to impose such fees without Congressional approval.
