Trump Fights BBC Subpoena for Family Testimony in Defamation Case

By Editor • August 22, 2026 • 2 min read

In a high-profile legal battle, former President Donald Trump is urging a federal court to reject the BBC's attempt to subpoena his family members, including his daughter Ivanka Trump and son Donald Trump Jr., in connection with a $10 billion defamation lawsuit. This lawsuit stems from a controversial episode of the BBC documentary series Panorama, which highlighted Trump’s actions surrounding the January 6, 2021, Capitol riots.

Trump's legal team argues that the BBC is conducting a "politically charged discovery campaign" that exceeds the limits of the case. They describe the subpoena requests as a "fishing expedition" aimed at gathering extensive information rather than addressing the specific issue at hand: the alleged manipulation of Trump’s speech during the January 6 rally that preceded the Capitol attack.

The crux of the lawsuit lies in the BBC's editing of Trump’s speech, where two separate statements were spliced together to appear as one continuous quote. The edited clip suggested a more direct incitement to action than what Trump intended, leading to accusations of defamation. Although the BBC has since apologized and removed the episode, Trump is persisting with his legal claims.

As the case unfolds in a southern Florida district court, the BBC has sought testimony from key figures, including Trump’s family, to clarify the context of Trump's actions on January 6. Both Donald Trump Jr. and Ivanka Trump were present at the rally, and the BBC argues their insights are crucial for understanding Trump's state of mind as the violence unfolded. Notably, text messages reveal that Trump Jr. urged his father’s chief of staff to swiftly condemn the violence, contributing to the narrative that Trump's rhetoric may have incited the crowd.

Despite efforts, the BBC has faced challenges in serving subpoenas to Trump’s family, primarily due to their Secret Service protection. In an attempt to circumvent these obstacles, the BBC has requested permission to send the subpoenas via certified mail. In response, Trump’s legal representatives have accused the BBC of harassing his family and conducting an unwarranted re-investigation into the January 6 events.

Furthermore, Trump's lawyers are invoking executive privilege in their defense, claiming that any communications involving Ivanka Trump and Jared Kushner should be protected due to their advisory roles. This assertion is bolstered by a recent memo from the Department of Justice, which extends executive privilege to interactions with private advisers, potentially complicating the BBC's efforts.
