Trump Administration Proposes $100K H-1B Visa Fee, Impacting Indian Workers

The Trump administration has unveiled a controversial new regulation that would impose a staggering fee of over $100,000 on new H-1B visas for foreign workers. This proposal, released on August 24, 2026, would make permanent a temporary fee introduced in 2025, significantly increasing the financial burden on companies that rely on these visas to attract skilled talent.

The H-1B visa program, which allows U.S. employers to hire foreign workers in specialty occupations, currently grants 65,000 visas each year, with an additional 20,000 for those holding advanced degrees. Historically, the application fees have ranged from $2,000 to $5,000, making the new fee unprecedented and likely to deter many employers.

Critics, including President Trump and some lawmakers, argue that the H-1B program is exploited by companies that substitute American workers with lower-cost foreign labor. However, numerous business groups assert that the program is vital for addressing the skills gap in the U.S. workforce.

As of February 2026, approximately 70 employers had already paid the new fee for 85 visa applications, according to court documents. The proposed fee of $103,265 could be finalized by year's end, which poses a particular challenge for Indian professionals who make up 71% of H-1B visa holders in fiscal year 2024. This fee could equal or exceed the annual salaries of many Indian H-1B workers, disproportionately affecting them due to generally lower median wages compared to peers from other nations.

Exemptions from this fee include visas for foreign nationals already in the U.S. on student visas and renewals of existing H-1B visas. The U.S. Chamber of Commerce, along with various unions and Democratic-led states, is actively challenging this fee in court, following a previous ruling that deemed it unlawful.
